But is the new document that the company must give to the employee of a contractual nature or is it merely informative? This post offers some recommendations to comply with transparency.

Royal Decree 723/2026, of September 9, which entered into force on October 5, 2026, partially transposes Directive (EU) 2019/1152 and repeals Royal Decree 1659/1998, which until now regulated the information to be provided to employees on the essential elements of the employment contract.

This regulation, applicable to employment relationships of more than four weeks’ duration, significantly expands the points on which information must be provided. By way of example, compared to Royal Decree 1659/1998, which was limited to requiring the amount of the basic salary and salary supplements and their frequency, the method of payment must now also be indicated, as well as the method of calculation and the criteria for receiving the variable items. As for the collective bargaining agreement, it is no longer enough to identify it: its code, date of publication, validity and, where appropriate, situation of ultra-activity must be indicated. It also incorporates, among other things, voluntary enhancement of conditions and pension plans, the assumptions and the procedure for modifying conditions, training, algorithmic systems or equality. The information must be provided before the start of the relationship, and the company must keep proof of its delivery.

The rule establishes a duty of information, and not a new source of obligations: rights and obligations continue to be regulated by legal and regulatory provisions, collective bargaining agreements, the will of the parties expressed in the contract, and uses and customs in the terms of article 3.1 of the Workers’ Statute.

In line with this, before the entry into force of the regulation, the SEPE published on its website the template “Information document on the essential elements of the employment contract”, without modifying the contract models, except for work in fishing and seafarers.

Recommendations and precautions

After the first month of application of the new regulation, practical questions emerge about how to comply with this duty. Here are some recommendations and precautions for preparing the information document on the essential elements of the employment contract that is given to employees:

Source of each condition. It must be indicated where each piece of information comes from (law, agreement, collective bargaining agreement, management decision or contract) and that the provisions of that source prevail in its version in force at any given time, so that, if it changes, nothing different from what is established in it is understood to be recognized. In matters that can be referred to, such as salary, working hours, holidays or probationary period, a precise reference to the agreement “from time to time” avoids transcribing figures that could be taken as agreed. In those that do not admit it, even if the condition must be described in the document itself, it should also be specified that, when it derives from a collective agreement, a collective bargaining agreement or an individual agreement, “the provisions of the [agreement or agreement] in force at any given time apply”, so that the description serves to inform and does not set the condition in the terms described.

Validity of the information. When the condition has a limited duration, it should be specified that the condition in force on the date of the document and for how long, without this implying its consolidation. This could be the case of variable remuneration plans or collective agreements with an end date; in the latter, moreover, their collective nature must be clear so as not to present them as an individual commitment.

Modifications. The duty to provide information does not end at hiring: modifications to what is informed must be communicated in writing, no later than the day on which they take effect, unless the information was given by reference to the law or the collective bargaining agreement and what changes is that source. Keeping the information up to date reinforces the temporary or variable nature of the condition when it has it. However, no reservation included in the document will protect the company if its subsequent practice contradicts it, nor will it allow the more favorable conditions already consolidated to be ignored.

In short, the duty of transparency should not alter the nature of the conditions informed. In any case, it is advisable to carefully review what is communicated and how it is communicated, so that informing does not become recognizing, adapting the precautions to the specific circumstances of each company and each issue.

Learn more about the subject: “Companies in Spain will have to provide information to their employees on elements including algorithms, equality or procedure for terminating contracts” and “‘Transparent and predictable’ working conditions and regulatory suffocation”.

María de los Ángeles López Correa

Royal Decree 723/2026 requires written information on the essential elements of the employment contract.
